Terms and conditions

1. General

1.1 Welcome to our General Terms and Conditions! We are glad you are here. This may not be the most exciting document you have ever read, but it is important that you know what you can expect from us and what we expect from you.

1.2 These general terms and conditions apply when you place an order with us via the website.

1.3 By placing your order, you agree to be bound by these general terms and conditions, or the "Terms" as we will refer to them from now on. Therefore, ensure that you have read and understood them before ordering.

1.4 To place an order, you must have the right to enter into agreements, which means you must be at least 18 years old and not be under guardianship. Orders paid for via iDEAL may be placed from the age of 16. You must also have a valid email address and a valid delivery address in the Netherlands (with the exception of the BES islands and ABC islands).

1.5 You cannot place an order for business, commercial, or self-employed activities. We do not issue commercial VAT invoices for business use.

1.6 We reserve the right to amend these Terms and Conditions, but the Terms and Conditions you approve at the time of your purchase will always apply to that specific purchase. All changes made will be incorporated into the latest published version of the Terms and Conditions in the Online Shop. Changes to the Terms and Conditions take effect from the moment you accept them. That is to say: when you make a new purchase. This means that we may, and likely will, change our Terms and Conditions from time to time. Therefore, keep visiting this page to stay informed.

2. Prices and delivery costs

2.1 The prices displayed in the Online Store include statutory Value Added Tax (VAT), but exclude shipping costs. At the checkout, the total cost of your purchase, including shipping costs, will be displayed.

2.2 Please note that prices in the online shop may differ from prices in our stalls.

2.3 The delivery costs are displayed at the checkout, where the available delivery options are also listed.

2.4 We may from time to time offer promotions, discount codes, gifts, and other offers. Such offers are valid only during the period indicated for such offers and under the conditions directly associated with them. Offers cannot be combined with other discounts, unless expressly stated otherwise in the Online shop. To take advantage of the offer, you must enter the discount code for the offer before completing the order.

3. Ordering

3.1 Do you want to place an order? Great! Here is how to do it. You collect the items you wish to order in your shopping cart using the "Add" button. In the shopping cart view, you can review your order and remove any item you change your mind about before proceeding to checkout. When you place your order by clicking "Proceed to checkout", you make a binding offer to purchase the items in the shopping cart. Depending on your chosen payment method, further steps may be required to complete your payment.

3.2 Upon receipt of your order, we will send you an automatic email confirmation that your order has been received. Please note: a placed order is an offer and does not constitute a binding contract until the order has been approved by us. If we approve your order, we will send you a confirmation email containing all relevant information regarding your order and the delivery. The shipping confirmation email is our approval of your order and the conclusion of our contract. Yes!

3.3 It may happen for various reasons that we are unable to approve your order. We reserve the right to reject your order for any 3.3.a. operational, 3.3.b. legal, or 3.3.c. commercial reason. This may happen, for example, if the item you ordered is broken and we no longer have it in stock, or if we suspect that items are being ordered for commercial resale purposes. If we are unable to approve your order, we will let you know as soon as possible after the automatic email confirmation has been sent, but of course before we approve your order and send you the shipping confirmation.

3.4 If we have already received a payment for an order that has not been approved by us, we will attempt to refund the amount in question via the same method used to place the order. If alternative arrangements are necessary for any reason, we will contact you to arrange the refund.

4. Payment

You can pay for your items in several ways, as described below. Depending on the payment method you choose, additional fees and conditions may apply.

4.1 Payment Methods
Credit card or debit card
You can enter your payment details when placing your order using a valid credit card or debit card (VISA, AMEX, or Mastercard). The relevant amount will be immediately reserved on your card and will only be debited when the items are shipped. The Hidden Spot reserves the right to verify the validity of the credit card or debit card, as well as the credit limit in relation to the order amount and the accuracy of the buyer's address details. We may refuse orders based on the outcome of these checks.

iDEAL
During the ordering process, you will be redirected to your bank to complete the payment. You have the option to pay via iDEAL if you bank online. Your payment will be debited from your account immediately.

Apple Pay
If you pay with Apple Pay, The Hidden Spot reserves the right to verify the validity of the Apple Pay account and the validity of the credit card or debit card, as well as your credit status in relation to the value of the order. We may also reject orders based on the results of the assessment. The corresponding amount will be reserved immediately on the selected card, but will not be debited until the goods have been shipped from our warehouse.

4.2 Other
You will receive your invoice in the email with the shipping confirmation.

5. Delivery

5.1. Once we approve your order, you will receive a confirmation email containing all relevant information regarding your order and the chosen delivery option.

5.2 Although we do our utmost to deliver within the stated timeframe, delivery may sometimes take longer due to unexpected events. If your order does not arrive at the estimated delivery time, please contact customer service. They will do their best to help you.

5.3 Sometimes life is busy and you forget to pick up your order or are unable to open the door for the delivery person. That is okay, we all know the feeling. However, if your order still cannot be delivered after multiple attempts, or if your order is still not collected from the pick-up point after multiple reminders, we reserve the right to charge you the costs for returning the order to us. This is an amount of €4.

5.4 Unfortunately, we do not deliver outside the Netherlands. Please note that we cannot deliver to business addresses.

6. Returns

6.1 Right of withdrawal

Have you changed your mind? No problem. Under EU consumer protection law, you have the right to withdraw from your contract. This means that you can cancel your purchase, in whole or in part, without giving any reason up to 14 days after the day of receipt, unless a legal exception applies.

6.2 You can exercise your right of withdrawal digitally at any time within this period via the customer service form. You can also exercise your right of withdrawal via other legally permitted means.

6.3 Withdrawal process and confirmation

After you have clicked the button/link:

(i) you may be asked to provide information strictly necessary to identify your agreement (such as your order number and email address); and

(ii) you will be asked to confirm your decision to withdraw via a clearly indicated confirmation option.

6.4 After submitting your request for withdrawal, we will send you an acknowledgment of receipt as soon as possible via a durable data carrier (for example, by email), containing the date and content of your request.

6.5 The withdrawal function remains continuously available and functional throughout the entire statutory withdrawal period.

6.6 You can return your items in various ways.

you can let us know that you wish to return something by sending an email to customer service. Then, place the item you wish to return in the package in which you received it, follow the instructions on the return form, and drop off the package at a designated drop-off point / service point, or contact the delivery service to arrange for it to be collected.

6.7 Please include the correct and complete item in the package; otherwise, we cannot process your return. We would like to emphasize that you can only return items purchased in the online shop. You may not include items purchased in our physical stalls in the package.

6.8 If you choose to return an entire order, we will refund the value of the order, but not the delivery costs. Unless otherwise stated in the Online Shop, you will be charged for the return shipping costs. These costs amount to €4.

6.9 The refund will be processed using the same payment method you used to place the order. This will happen as soon as possible and no later than 14 days after we have received the items back or you have provided proof that you have returned the items. If you have not received your refund within 10 working days, please contact customer service and we will assist you further.

6.10 We will give you a full refund for any returned item, provided that it is returned in the same condition as when received. If an item is damaged, dirty, washed, altered, or worn in any way (other than trying it on) and the value of the item has decreased, we reserve the right to deduct an amount from your refund corresponding to the diminished value of the item. Therefore, please handle the items with care.

6.11 The right of withdrawal and return does not apply to sealed products that are unsuitable for return for reasons of health protection or hygiene if the seal has been removed, such as certain food , earrings, other jewlery. The right of withdrawal and return does not apply to items that spoil or expire quickly, such as perishable products.

Returning perishable products:

i. The right of withdrawal and return does not apply to goods with a short shelf life or that spoil or expire quickly, such as perishable products, including cut flowers.

7. Defects

7.1 Is there a problem with the item you ordered? Under applicable consumer protection legislation, all products must be free from defects, which means they must conform to the sales agreement, be fit for their intended purpose, and perform just as well as other products of the same type. File a complaint with us if this is not the case, and we will be happy to assist you.

7.2 For any item that remains defective, depending on the item, the defect in question, and your request, we will offer to repair the item or replace it with a new one. If this is impossible or would entail disproportionately high costs, we will offer you a price reduction or refund, depending on your preference.

7.3 Your statutory warranty rights under applicable law remain unchanged.

8. Your warranty rights

As a consumer, you are protected by a statutory warranty under applicable law. For goods sold within the EU, this warranty applies for at least two years.

9. Our liability

9.1 We will make every reasonable effort to ensure that the information in our Online shop is accurate, complete, and up-to-date. Despite our efforts, the information may sometimes be inaccurate, incomplete, or outdated. We are not bound by such information if you knew or should have known that the information was inaccurate, incomplete, or outdated.

9.2 We do our best to accurately display and describe the properties of our products in the Online Shop regarding dimensions, composition, and colors. However, how the color is displayed depends on your device. The dimensions we state are only approximate values to help you better estimate the model or fit of that specific item. We do not guarantee the actual dimensions of the item you receive, as the final dimensions may vary depending on the material used in production. If you are not satisfied with the item you ordered, you may return it. See section 6 (Returns).

9.3 What happens if things really go wrong? In the event of an occurrence beyond our control that we cannot reasonably prevent and could not foresee, we are no longer under an obligation to fulfill our contract with you. Such an occurrence may include: government intervention or failure, new legislation, an employment dispute, strikes by a carrier, war or the threat of war, serious disruption of public order, sabotage, extreme weather conditions, fire, explosion, pandemic, epidemic, virus, and natural disasters. If any of these events occur, we are not obliged to compensate you for damages. Remember that as a consumer, you always have the right to cancel your purchase under such circumstances. If your order has already been shipped, you may refuse it upon delivery.

10. Complaints and dispute resolution

10.1 If you have a complaint about one of our products or services, please let us know by contacting customer service; include your contact details and, if applicable, any potential costs such as paid numbers.

10.2 We adhere to the applicable alternative local dispute resolution mechanisms for the settlement of potential customer complaints.

10.3 We comply with applicable mandatory consumer protection legislation and we do not intend to exclude or limit the rights you have through our Terms.

11. Separability

Subject to applicable law, if any clause in these Terms and Conditions proves to be unenforceable for any reason, this shall not affect the enforceability of other clauses in these Terms and Conditions.
